Upon installation of the application of the Belong Platform on your device, the Belong Platform shall prompt You to Sign-up/ Register/ Sign-in to use the Belong Services on the Belong Platform using your Account Credentials. The Belong Platform also permits the User to sign-up/ Register/ Sign-in to their user account using an OTP. Where the User does not have a user account with Belong, the Belong Platform will prompt such User to register with Us towards opening a user account.

Please read the terms and conditions carefully before registering, accessing or using the Belong Services (defined below). These terms and conditions (“Terms”) are a legal and binding agreement between You (“User” / “You”) and Belong (as defined below). These Terms state the grounds on which the User can sign up, register with Belong through Belong Platform (as defined below) and use the Belong Platform. Terms are updated from time to time at Our sole discretion and the most updated version is available on the Belong Platform at all times along with the date of last revision. Continued use by the User of the Belong Platform after any revision indicates the User’s acceptance of the updated/ revised Terms. You understand and agree that you are solely responsible for reviewing these Terms from time to time.
The Belong Platform is operated by Betafront Financial Services (IFSC) Private Limited, a private company incorporated in accordance with the laws of India and having its registered office at Unit No.109, Seat No.1-4, Ground Floor, Pragya Accelerator II, Building 15 B, Block - 15, GIFT SEZ, GIFT City, Gandhi Nagar, Gujarat, India - 382355.
USING BELONG APP INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING. By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by Belong and its Policies (including but not limited to Privacy Policy) available on the Belong website and Belong App as amended from time to time.
1. DEFINITIONS
In this Terms the following terms shall have the following meanings:
(a) “Access Credentials” shall mean the user ID used by a User to set-up, access and operate their account on the Belong Platform.
(b) “Applicable Data Protection Laws” means the applicable data protection legislation or regulations supplementing it in those jurisdictions in which relevant services are provided to User by Belong from time to time, and included where relevant, the UK Data Protection Act 2018, the EU GDPR 2016, Personal Data Protection Law (PDPL), Digital Personal Data Protection Act (DPDP Act), or any other applicable act.
(c) “Applicable Laws” means any applicable Indian statute, law, ordinance, regulation, rule, order, byelaw, administrative interpretation, writ, injunction, directive, judgment or decree or other instrument which has a force of law in India, as is in force from time to time or other instrument which has a force of law in India, as is in force from time to time.
(d) “Belong”, “We”, “Our”. “US” shall be a reference to Betafront Financial Services (IFSC) Private Limited, a private company incorporated in accordance with the laws of India and having its registered office at Unit No.109, Seat No.1-4, Ground Floor, Pragya Accelerator II, Building 15 B, Block - 15, GIFT SEZ, GIFT City, Gandhi Nagar, Gujarat, India and Belong Group Entities;
(e) “Belong Group Entities” shall be a reference to Betafront Financial Services (IFSC) Private Limited, its holding company Betafront Technologies Private Limited, subsidiaries and affiliates of Belong;
(f) “Belong Platform” means the platform/ mobile application(s) by the name ‘Belong/Belong - NRI Save & Invest’, hosted by Belong for providing Belong Services to the Users, and Commercial Partners;
(g) “Belong Services” means and include all services offered / to be offered by Belong and Belong Group Entities either directly or through its Commercial Partners.
(h) “Commercial Partner” means any individual or entity with whom Belong or Belong Group Entities have a contractual relationship and includes but is not limited to entities offering financial products on Belong Platform.
(i) “Eligibility” By accessing Belong Services and Platform, You represent that:
● You are 18 years of age or older.
● You are capable of entering into a contract /legally binding agreement.
● You have the right, authority and capability to enter into this Agreement abiding by all the provisions of the “terms of use” of Belong Services.
● You are not barred or otherwise legally prohibited from accessing or using services of Belong or Belong Entities under the laws of India.
● You are not impersonating any person or entity or falsely stating your age or affiliation with any person or entity. Belong shall reserve the right to terminate your contract to use Belong Platform in case of any incorrect representation of the above-mentioned conditions.
● The mandatory information and officially valid document(s) “OVD”/ document details mentioned by you are true & correct and belong to You.
(j) “OTP” means one time password which means any password or other means of authentication (including email authentication) which facilitates the User to log into their user account in a secured manner.
(k) “USD” shall mean United States Dollars.
(l) “Wallet” shall be a reference to the digital wallet of the User, which facility shall be provided by Belong upon the user account having been opened on the Belong Platform and Belong have conducted the user verification.
2. USER REGISTRATION, USER VERIFICATION AND TERMS OF USER ONBOARDING
2.1
2.2 User Registration & Identification
(a) To access Belong Services, the User shall create an account on Belong Platform by setting a customer ID linked to their email address and mobile number, both of which will be verified through a one-time password (OTP) .
(b) The User agrees to implement reasonable security measures to protect:
(c) The User agrees to upload correct and accurate information, including identity and verification details, during the onboarding process through Belong Platform. You are also required to keep your accounts, KYC details and contact information complete and updated at all times
(d) The Belong Services are available for use to Users who are tax residents of the United Arab Emirates only. The Belong Platform shall prompt the User to declare that they are tax residents of the United Arab Emirates at the time of registration on the Belong Platform.
2.3 User Verification
(a) Belong shall ensure that the User's identity and residential status is validated, verified, and enrolled in accordance with the regulatory requirements (KYC).
(b) It is clarified that Belong shall be entitled to verify the User’s KYC through In Person Verification (IPV) or Virtual KYC process (VKYC), or a combination of both. Towards undertaking the KYC, Belong may engage agents/ delegates on its behalf.
(c) Belong reserves the right, at its sole discretion, to verify, validate, and authenticate any information, data, or documentation provided by the User, including but not limited to conducting KYC or other due diligence checks, for the purpose of ensuring the accuracy, authenticity, and legitimacy of such information in accordance with Applicable Laws and internal policies of Belong.
2.4 User sign-in
(a) Upon successful completion of the registration process, the User shall be able to sign-in on the Belong Platform. It is however clarified that the availing of Belong Services on the Belong Platform by the User shall be subject to the completion of the User Verification by Belong.
(b) The Belong Platform may require the User to provide the Account Credentials at the time of sign-in. In the alternative, the Belong Platform may permit the User to sign-in using an OTP, which would be generated by Belong and shared on the phone number or email ID shared with Belong.
(c) In some devices, the Belong may also integrate the (1) biometric sign-in services and/ or (2) the facial ID sign-in services and in such instances, the User shall be required to sign-in using the biometric/ facial ID sign-in services only.
(d) Using the Biometric/ Facial ID services towards sign-in and availing Belong Services
(i) The biometric sign-in service enables the User to access the Belong Platform via fingerprint or face ID on a permitted mobile device which has the fingerprint or face ID features, in lieu of username and OTP.
(ii) To use this service:
A. The User must be registered on the Belong Platform and use a permitted mobile device with the mobile application that has been installed; and
B. The User shall have enabled and registered their fingerprint or face ID specifications on their permitted mobile device.
(iii) Any use of a registered biometric on a permitted device shall be deemed authorised access to the Belong Platform and/or instruction to perform a transaction.
(iv) Disclaimers:
A. Belong does not provide or warrant the security or functionality of the biometric features of the permitted mobile device.
B. Belong disclaims liability for any loss arising from use, attempted use, or misuse of the biometric login service, including unauthorised transactions.
C. Belong may, at its own discretion, suspend the biometric / facial ID feature on the Belong Platform, in which case the User may sign-in on the Belong Platform using its Account Credentials and OTP.
D. The User agrees to indemnify Belong against any loss or damage resulting from improper use of the biometric login service to access Belong Platform.
2.5 Additional Terms on User onboarding
(a) Belong may request additional information from the User from time-to-time to comply with Applicable Laws.
(b) The User expressly agrees and consents to be held liable and accountable for all activities that occur through their user account.
(c) Belong shall not be held liable for any unauthorized investments made through the User’s account due to unauthorized access, including but not limited to hacking or security breaches.
2.6
The User agrees to promptly provide any requested documents and evidence at any stage of using the Belong Services. Belong may require additional information to verify the User’s identity before permitting payments or fund transactions from the account. The User agrees to furnish any information required by Belong for identity validation or to confirm the authenticity of their registered funding instrument. If the User is unable or unwilling to provide the requested information, Belong reserves the right to offboard the User and close the account.
3. USE OF THE BELONG PLATFORM
3.1 User account
(a) Upon successful completion of the registration process in terms of Clause 2.2. above, the User shall have opened a user account on the Belong Platform.
3.2 Belong Services
(a) Upon completion of the verification process by Belong, the User shall be entitled to avail the Belong Services including using the user Wallet. The Belong Services shall be available on display for the user account upon signing-in to the Belong Platform. It is clarified that Belong may, at its own discretion, restrict one or more Belong Services (including offerings by Commercial Partners). Such discretion may be exercised on the basis of various factors including the residency of the User and the permissibility of Belong / Commercial Partners to operate / present their offerings in such jurisdiction.
(a) User wallets
(i) Towards availing the Belong Services and transacting with the Commercial Partners the User shall be entitled to use the Wallet services on the Belong Platform. Belong shall permit the User to add and use monies on the Wallet.
(ii) You may add money to your wallet using an active bank account or approved banking channels or from NRE, NRO, or FCNR accounts, the details of which have been previously verified by Belong. The User is solely responsible for complying with local laws when accessing the Belong Platform and will indemnify Belong for any liabilities incurred due to such usage. It is further clarified that the User may add monies to the Wallet in any freely convertible foreign currency including USD. In the event that the User proceeds to add monies to the Wallet in any other freely convertible foreign currency other than the USD, the balances shall then mandatorily be converted into USD basis the terms of conversion agreed with the Commercial Partners by Belong.
(iii) At any point, during the use of the Wallet, the minimum amount could be added at a single instance shall be USD 5,000 (United States Dollars Five Thousand only) and the maximum balance that can be loaded on the Wallet shall not exceed USD 10,000,000 (United States Dollars Ten Million only). The terms of minimum amount to be added and the maximum amount loadable on the Wallet could be amended from time-to-time by Belong at their sole discretion and intimated to the Users. The balances in the Wallet shall be non-transferable and cannot be transferred to any other User.
(iv) Any monies added by the User on the Belong Platform, shall be added to the balances in the Wallet. The User shall be entitled to: (1) transfer the available credit balances in the Wallet; or (2) transact with the Commercial Partners on the Belong Platform.
(v) You further agree and acknowledge that your bank may charge fee(s) or other charge(s) against any transaction towards adding balances to your Wallet. Belong shall not be liable to acknowledge or refund such fee(s)/ charge(s) and the same shall be borne by You in all circumstances as per the terms agreed between you and your bank.
(vi) Funds loaded into Your Wallet and spent on Belong Services including for services offered by Commercial Partners, are conducted over the internet and involve multiple stakeholders including but not limited to Your bank, service providers internet services, telecom operator etc. You understand that transaction confirmations and acknowledgements may not always reflect service delivery due to the possibility of failures at multiple points. In such cases, Belong is not liable for any loss caused due to inefficiencies / process failures at other such stakeholders and Belong shall credit the funds or recover the funds from You in such cases and shall apply appropriate limits/restrictions on Your Wallet or account accordingly at its own discretion, and can take appropriate legal actions to collect the amount due (if any), to the extent allowed by applicable law.
(vii) Belong may monitor your transactions for probable risk/ fraudulent or suspicious transactions. Basis monitoring, Belong shall be entitled to take any action as it deems necessary such as placing a hold on the transactions, blocking the transaction blocking any transactions using the Wallet. Belong may ask for additional information before releasing / reinstating the user account or transaction wherever applicable. Belong shall not be liable for any loss caused to You in such an event even if the transaction has been found to be regular/ lawful at a later stage.
(b) Offerings by Commercial Partners
(i) The Belong Platform shall display the offerings by the Commercial Partners including but not limited to term deposit products. The User may select one or more such products and transact on the Belong Platform to avail of such Product.
(ii) Belong’s role in relation to product(s) is limited to facilitating the transaction and could involve ancillary actions such as facilitation of the setting up of a term deposit account in respect of the offering by the Commercial Partner. Any offerings of the Commercial Partners are products offered by Commercial Partners as principals and such offering is not a product and/or service provided by Belong on the Belong Platform.
(iii) Belong shall not in any way be deemed to be making any representation or warranty whatsoever in connection with the offerings of the Commercial Partners, including in relation to its adequacy or validity. Belong shall under no circumstances be responsible, directly or indirectly, for any deficiencies in the Commercial Partners’ offers. Further, the User understands that Belong does not make any claims nor does it have any responsibility towards the performance/ commercial viability of the offerings by the Commercial Partners.
(iv) Belong does not guarantee, explicitly or implicitly, any rate of return, interest rates offered by the Commercial Partner(s).
(v) The User agrees and confirms that, in addition to the Terms mentioned herein, they will be subject to the terms and conditions of the respective fixed deposit issuer i.e Commercial Partner and shall fulfil any requirements pertaining to KYC, bank account verification or any such information or documentation required by the Commercial Partner, should they wish to avail of the fixed deposit offered by the respective Commercial Partner.
(vi) DISCLAIMER: Term deposits offered by Commercial Partners are governed by the applicable regulations specified by the International Financial Services Centres Authority (IFSCA) and other applicable regulatory frameworks. These deposits are available to non-resident Indians (NRIs) and other eligible investors, subject to the terms and conditions set forth by the respective financial institutions. Interest rates, tenure, tax implications, and withdrawal policies may vary and are subject to regulatory guidelines. Users are advised to review the specific terms of their chosen term deposit product before making an investment.
[Fixed Deposits (FDs) offered in GIFT City are governed by the applicable regulations of the International Financial Services Centre (IFSC) and the Reserve Bank of India (RBI). These deposits are available to Non-Resident Indians (NRIs) and other eligible investors, subject to the terms and conditions set forth by the respective financial institutions. 4 DECLARATIONS BY BELONG
4.1 Belong shall perform its duties and obligations described in these Terms with the highest
standards of integrity and fairness and shall act in an ethical manner in all its dealings with the User.
4.2 Belong has taken all commercially reasonable steps to protect the confidentiality of confidentialdata or non-public information provided to it by the User and shall not disclose the same in any manner, except as provided under this Terms.
5 DECLARATIONS BY THE USER
5.1 The User has satisfied itself that Belong possesses requisite level of knowledge and competence to provide the services offered.
5.2 The User agrees and unconditionally confirms that it shall protect and keep confidential their Access Credentials at all times and any disclosure to third parties shall be entirely at their risk. Users shall ensure that their Access Credentials are not disclosed to any other person. The User agrees not to share its Access Credentials with any third party and will take reasonable measures to maintain the confidentiality of these credentials, including regularly updating passwords and ensuring password complexity
5.3 The User acknowledges that Belong is not responsible for any transactions resulting from the misuse of its Access Credentials. The User shall implement appropriate security measures to prevent unauthorized access to its Belong Platform account and Belong shall not be liable for any such unauthorized access.
5.4 The User authorizes Belong to transmit any requests made via its Belong Platform account, authenticated by the User’s Access Credentials, for executing instructions related to purchasing, redeeming, switching, selling, or other transactions/activities, services on the Belong Platform, whether directly or through a Commercial Partner, as per the terms set forth herein.
5.5 The User confirms that it is availing the execution services provided by Belong of its own volition and has not been compelled to avail execution services offered by Belong.
5.6 The User understands that availing of the Belong Services and participating / investing in offerings by Commercial Partners may be an event of tax incidence and may subject the User to a tax liability. The User acknowledges that it is availing the Belong Services having considered the possible tax incidence, tax implication and tax liability.
5.7 The User agrees not to hold the Belong, Belong Group Entities its directors, officers, representatives, or employees liable for any claim, loss, damage, expense, or legal breach resulting from the User’s decision to utilize Belong Services offered on the Belong Platform, whether directly or through Commercial Partners.
5.8 The User understands that investment returns are not guaranteed and confirms that it has reviewed, or will review, all relevant investment documents prior to making any investment decisions.
5.9 The User acknowledges that several services on the Belong Platform are provided in collaboration with other companies or firms.
5.10 The User acknowledges that service-specific and Commercial Partner specific terms and conditions will be shared on the product pages or during the onboarding process of Belong Platform, and the User agrees to review these before initiating any transactions. The User consents to share personal information, including KYC details, with Commercial Partners as required for availing Belong Services.
5.11 The User agrees to provide accurate and complete information as requested on the Belong Platform.
5.12 The User agrees not to upload or transmit any malicious programs, such as viruses, trojan horses, spyware, or harmful code, onto the Belong Platform.
5.13 The User agrees to review the terms and conditions of any service offered directly by the Belong Platform or through a Commercial Partner, as displayed either on the Belong Platform or the Commercial Partner’s website, before availing the offering. These features, where applicable, include but are not limited to minimum transaction amounts, validity periods, lock-in periods, maturity periods, methods of purchase, redemption, reversals, returns, refund terms, and eligibility criteria. The User agrees to comply with the terms, conditions, regulations, and risk factors of the relevant offering at the time of the transaction.
5.14 The User confirms that it has not received or been induced by any rebates or gifts, directly or indirectly, in relation to any transactions made through the Belong Platform.
6 INDEMNIFICATION
6.1 You agree to keep indemnified and hold Belong Group Entities, its Commercial Partners and
their officers and agents free and harmless at all times, against all monetary and other harm, injury, costs, losses, liabilities, damages, charges, actions, legal proceedings, claims and expenses and consequences including without limitation any costs between attorney and client, whether direct or indirect, by reason of using the Belong Platform account and/or doing and/or omitting to do anything in accordance with the Terms specified herein or any instructions relating to the online dealing in Belong Services provided through the Belong Platform.
6.2 You agree and undertake not to hold Belong and its Commercial Partners liable for the following:
(a) for any breach or non-compliance by You of these Terms.
(b) any delay or failure in processing the transactions carried out by You due to any system failure or for any other reason whatsoever.
(c) for any tax liability that may arise on the User for transacting on Belong Platform or while availing the Belong Services on the Belong Platform.
(d) for any loss or damage incurred or suffered by You due to any error, defect, failure or interruption in the dealing arising from or caused by any reason whatsoever.
(e) for any fraud, negligence/mistake or misconduct by You including failure to comply with the KYC norms or provision of a valid Permanent Account Number (PAN) or anti-money laundering requirements. (f) for not permitting You to deal after such reasonable verification as Belong and its Commercial Partner may deem fit.
(g) for permitting any person who provides Belong with the Access Credentials to deal with the Belong Platform account. Belong and Commercial Partners shall be under no obligation to further ascertain Your identification at the time of transactions.
(h) for any loss or damage incurred or suffered by You due to withdrawal or termination or suspension of this facility arising from or caused by any reason whatsoever.
(i) Notwithstanding anything contained herein, Belong shall incur no liability to the User for any act, done or omitted to be done, in good faith and with bona-fide intentions, by reason of:
(i) any provision of any applicable law; or
(ii) any decree, order or judgment of any court;
(iii) it becomes impossible or impracticable for Belong to carry out any of the provisions of this Terms.
(j) You agree that this undertaking shall be valid until such time You have not expressly informed in writing that You do not wish to deal or transact any longer and it shall be also valid in respect of any claims made on account of or relating to your dealing with Belong.
(k) Notwithstanding anything mentioned in this agreement, the maximum liability of Belong and Commercial Partners to You shall not exceed the amount of any fee paid by You for availing Belong Services through the Belong Platform.
6.3 The indemnities given in this Clause shall survive the termination of these Terms.
7 DATA PROTECTION AND PRIVACY
7.1 In connection with the provision of Belong Services, Belong may periodically access certain personal data from the User, which will be processed by Belong on behalf of User. Both the User and Belong acknowledge and agree to adhere to all Applicable Data Protection Laws at all times. The terms of collection, storage and use of Your data shall be governed by the privacy policy (accessible here - https://getbelong.com/privacy-policy/), which shall be deemed incorporated to these Terms by reference.
8 SUSPENSION AND TERMINATION
8.1 Termination by the User:
(a) The Belong Platform permits the User to close their Wallet and delete their user account at their discretion. You may undertake the same by placing a request via email to [support@getbelong.com] or in such other manner as may be specified by Belong.
8.2 Termination and suspension of use of the Belong Platform by Belong:
(a) Belong reserves the right to refuse service to any User, if in Belong's sole discretion it is determined that:
(i) the User does not complete the user verification within 30 business days of the registration on the Belong Platform; or
(ii) Upon user verification, Belong is of the opinion that the User is a tax resident of a jurisdiction not serviced by Belong or if there is any suspected discrepancy in the KYC documentation or information provided by You; or
(iii) any activity is carried out by the User that is prejudicial to the interest of Belong or undertaken with an intent to abuse the system with malafide or fraudulent intent or that results in non-compliance with these Terms; or
(iv) for any violation or suspected violation of any applicable law;
(v) to combat potential fraud, sabotage or threat to national security.
(b) The Belong Platform and Belong Services provided therein may at any time be suspended / disallowed /modified for such reason and for such time period as deemed fit by Belong including but not limited to no activity or suspicious activity in the User account, non-compliance of the Terms stated herein, death, insolvency, bankruptcy of the User, any other cause arising out of the operation of law or such other reason as is deemed proper.
(c) You agree that, upon closure or winding up of Your user account or Your Wallet as notified by any regulator or due to any circumstances provided under Applicable Law, the outstanding balance (if any) shall be handled as per any instruction by the regulator or as deemed necessary by Belong.
8.3 The user account on the Belong Platform may be terminated by providing the User with 7 days of intimation/notice to their registered e-mail id or by way of SMS to their registered phone number. It is however clarified that where Belong intends to act in furtherance of Clause 8.2.(a) or Clause 8.2.(b) above – it shall not be required to give any notice to the User and may cause immediate suspension / cessation of use of the Belong Platform by the User.
8.4 In case the User ceases to be a user of the Belong Platform, all relevant details will be provided to the Commercial Partners as the case may be and as are required by them to enable User to deal and interact directly with the Commercial Partner.
8.5 Users agree and understand that termination of their relationship with the Belong Platform for any reason, shall result in losing access to their Belong account and the inability to carry out further transactions through the Belong Platform. This will not automatically result in termination of any Commercial Partner services already availed or redemption of any purchase already made by Users as on the date of termination.
9 GRIEVANCE REDRESSAL MECHANISM
9.1 Users’ may reach out to Belong with respect to any queries, complaints, grievances through the help tab on Belong Platform or available on the website under the tab “Complaint Handling and Grievance Redressal”.
9.2 Complaints will be managed according to the policy available on the App & website.
9.3 All the complaints received are duly monitored and redressed by the CRO. The register of grievances is centrally maintained for better control and monitoring; Thus, the grievances received in writing, mail, verbally, etc. are centrally monitored and redressed and recorded with all the necessary steps taken for redressal of the same. Proper analysis is undertaken to analyse the nature of complaints received, pattern of complaints and concentration if any at a particular location so that every effort is taken to remove the root cause of the grievance by the User. Periodic visits and inspections are undertaken for the branches and authorised partners to get the feedback of Users on the issues. Depending on the feedback received, necessary or corrective steps are introduced into the system.
10 DISCLAIMER
You expressly acknowledge and agree that use of Belong Platform and Belong Services is entirely at Your own risk and that the Belong Platform and Belong Service are provided on an “as is” or “as available” basis, without any warranties of any kind. All express and implied warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights are expressly disclaimed to the fullest extent permitted by Applicable Laws. To the fullest extent permitted by Applicable Law, Belong, Belong Group of Entities, its officers, directors, employees, affiliates and agents disclaim all warranties, express or implied, in connection with Belong Platform and Your use thereof. Belong makes no warranties or representations about the accuracy or completeness of the Belong Platform’s content or the content of any third-party websites linked to the Belong Platform and assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from Your access to and use of the Belong Platform and Belong Service; (iii) any unauthorized access to or use of Our servers and/or any and all personal information and/or financial information stored therein; (iv) any interruption or cessation of transmission to or from the Belong Platform; (iv) any bugs, viruses, trojan horses, or the like which may be transmitted to or through Belong Platform by any third party; and/or (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, communicated, transmitted, or otherwise made available via Belong Platform or Belong Service. Belong does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party/Commercial Partner through the platform or any hyperlinked website or featured in any banner or other advertising, and Belong will not be a party to or in any way be responsible for monitoring any transaction between You and/or other Users and/or third-party providers of products or services. As with the purchase of a product or service through any medium or in any environment, You should use Your best judgment and exercise caution where appropriate.
11 TIMEZONE DIFFERENCE FOR CREDITING USER’S ACCOUNT
Due to the nature of the services offered by Belong and its Commercial Partners to Users located across various regions globally, involving coordination among multiple parties and across different time zones, the crediting of the User's account/ updation may take up to 15 days from the time the User initiates the transaction on the Belong Platform. In the unlikely event that the amount is not successfully credited 15 days after the processing of the transaction to the User's or account/ account has not been updated, Belong will ensure that the appropriate refunds are promptly processed and issued to the User.
12 LINKS TO OTHER WEBSITES
Belong Platform may contain links to external websites or services that are owned and operated by third parties, over which Belong exercises no ownership or control. Belong disclaims any responsibility for the content, privacy policies, or practices of such third-party websites or services. The User further acknowledges and agrees that Belong shall bear no responsibility or liability, either directly or indirectly, for any harm, loss, or damage suffered, or alleged to have been suffered, as a result of the use of, or reliance on, any content, products, or services provided through or available on such third-party websites or services. Belong strongly recommends that the User carefully review the terms and conditions, as well as the privacy policies, of any third-party websites or services that the User accesses through links provided on the Belong Platform.
13 LIMITATION OF LIABILITY
13.1 Financial and non-financial transactions performed by You on Belong Platform is always processed by You or under Your exclusive authorization. In no event shall Belong, their officers, shareholders, subsidiaries, associate companies, directors, employees and agents, partners, licensors, licensees, consultants, or contractors be liable to You or any third party for any special, incidental, indirect, consequential or punitive damages or losses whatsoever, or damages for loss of data or profits, goodwill, and/ or other intangible loss, whether or not foreseeable and regardless of whether Belong has been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with Your use of, or access to, the Belong Platform, or the Belong Services.
13.2 In no event shall Belong’s total cumulative liability to You in connection with Belong Services for all damages, losses and causes of action (whether arising under contract or otherwise), arising from or relating to Your use of the Belong Platform or arising from these Terms exceed the fees collected from the User in the preceding 12 (twelve) months.
13.3 You specifically acknowledge and agree that the Belong shall not be liable for User submissions or the defamatory, offensive, or illegal conduct of any User or third party and that the risk of harm or damage from the foregoing rests entirely with You.
14 Communication
Belong may communicate with you on the contact information that you may have provided to Us during the course of your engagement, including but not limited to sign-up, transacting or availing any other services on Belong Platform.
We will send you communication alerts via emails or SMS or push notifications or via other progressive technology. You also agree that there can be disruption in communications due to factors that are not under Our control, including but not limited to Your Phone being switched off, incorrect email address, network interruptions. You agree not to hold Belong liable for non-delivery for any alert or any loss suffered by you due to delay, distortion or failure of communication.
You further acknowledge that you are responsible for the contact details shared with Us and shall update us on any change on your contact details. You authorize Us to contact you and communicate with you for any Belong Service or Offer(s). We may use third party service providers to send alerts or communicate with you. You authorize Belong to override the DND settings to reach out to you over calls, SMS, emails and any other mode of communication.
15 IP PROTECTION
15.1 The User acknowledges that all text, images, trademarks, logos, compilations (defined as the collection, arrangement, and assembly of information), data, other content, software, source code, know-how, and materials displayed on Belong’s Platform or utilized by Belong are the proprietary property of Belong.
15.2 Belong expressly reserves all rights, including all intellectual property rights, in connection with the aforementioned materials. Except as explicitly permitted by these Terms, any use, redistribution, sale, decompilation, reverse engineering, disassembly, translation, or other exploitation of such materials is strictly prohibited. These Terms do not confer upon the User or any third party any rights, title, or interest in or to such intellectual property rights.
15.3 The User agrees, represents, and warrants that their use of Belong Services, or any part thereof, will adhere to the aforementioned covenants and restrictions and will not infringe upon or violate the rights of any third party or breach of any contract or legal obligation owed to any other parties.
16 GENERAL PROVISIONS
16.1 Governing Law and Jurisdiction: The Belong Platform, the Belong Services, and Our relationship shall be governed by the laws of India, without regard to conflict of law principles. You agree that subject to the Clause 15.2 below, all claims, differences and disputes which We may have shall be subject to the exclusive jurisdiction of the competent courts located in Gandhinagar, India.
16.2 Dispute Resolution and Arbitration: In consideration for Belong granting You access to and use of the Belong Platform and the Belong Services. These Terms shall be exclusively governed by and construed in accordance with the laws of India. Any dispute, conflict, claim or controversy arising out of or broadly in connection with or relating to the services or these Terms, including those relating to its validity, its construction or its enforceability (any Dispute) shall be, if initiated by the User, as provided under Clause 9 (Grievance Redressal Mechanism) above. If such Dispute has not been settled within 15 days in the manner set out in Clause 9 above, then such Dispute can be referred to and shall be exclusively and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (Act). Provided however when Belong raises any dispute, Belong may directly initiate arbitration in accordance with this clause. The Dispute shall be resolved by 1 (one) arbitration, who shall be appointed in terms of the Act. The place the arbitration shall be Bengaluru, India. The language of the arbitration shall be English. The existence and content of the arbitration proceedings, including documents and briefs submitted by the parties, and correspondence, orders and awards issued by the sole arbitrator, shall remain strictly confidential and shall not be disclosed to any third party without the express written consent from the other party unless: (i) the disclosure to the third party is reasonably required in the context of conducting arbitration proceedings; and (ii) the third party agrees unconditionally in writing to be bound by the confidentiality obligation stipulated herein.
16.3 Assignment: You shall not transfer or assign any of Your rights and obligations arising from these Terms. You agree and acknowledge that Belong may assign or transfer its rights and obligations under these Terms in whole or in part, to (i) any other group entity; (ii) an acquirer of Belong or Belong Group Entities or their respective equity interest, business or assets; or (iii) a successor entity resulting from any corporate action including mergers or demergers.
17 Acceptance of Terms
17.1 You affirm that You are competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms.
17.2 By using Belong Services, You accept the Terms of Belong.
17.3 By using Belong Services, whether through a mobile device, mobile application, or computer, You agree to be bound by: (i) these Terms, which We may amend from time to time; (ii) Privacy Policy (https://getbelong.com/privacy-policy/); and (iii) any additional terms upon registration. If You do not accept and agree to be bound by all of the terms, You are not entitled to use Belong Services.
17.4 By registering with Belong and accessing the Belong Platform, You are representing the following:
(a) You are capable of entering into a legally binding agreement;
(b) You are not barred or otherwise legally prohibited from accessing or using the Belong
Platform and Belong Services;
(c) You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a `terrorist supporting` country, (ii) You are not listed on any United States government list of prohibited or restricted parties, (iii) You confirm that you are not a resident or national of a jurisdiction identified by the FATF as having strategic deficiencies (grey list) and You are not an individual or entity designated under the Unlawful Activities (Prevention) Act, 1967 (UAPA)..
(d) You confirm that you were 18 (eighteen) years of age or older at the time of onboarding; and
(e) If You allow anyone to use Your account, including individuals under 18 (eighteen) years of age, You will still be responsible for ensuring that such individuals comply with these Terms of Use. You will be responsible for all actions these individuals take in and/or through your account. You also acknowledge that Belong does not have the responsibility of ensuring that You meet the aforesaid eligibility requirements.
18 Refund and Cancellation Policy
